GENERAL TERMS AND CONDITIONS
The following General Terms and Conditions also contain legal information on your rights in accordance with the regulations on contracts in distance selling and electronic commerce.
1 Scope of application, contractual partners
1.1 These General Terms and Conditions (“GTC”) apply to all contracts concluded between you as the customer (“you”) and the company nacani GmbH (“nacani”) as the operator of the online store at www.nacani.de (“nacani webshop”). As part of the ordering process, you accept the GTC in the version valid at the time the order is placed. Deviating or supplementary general terms and conditions of the customer shall only apply if nacani has agreed to them in text form in individual cases.
1.2 These GTC apply to consumers. According to the legal definition (§13 BGB), a consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside his trade, business or profession.

2 Conclusion of contract
2.1 The presentation of the products in the webshop does not constitute a binding sales offer. The goods you select are initially collected in a virtual shopping cart. Goods in the shopping cart are not reserved for you and can be purchased by other customers in the meantime. After entering your contact details, payment and shipping information, you submit a binding purchase offer by clicking on the order button. Before doing so, you have the opportunity to check your details and, if necessary, change them or correct any input errors. Your binding order can only be sent if you have expressly accepted these GTC. The offer to conclude a purchase contract is made by you as the customer by clicking the [Submit order] button.
2.2 Confirmation of receipt of your order will be sent by an automated e-mail immediately after you have sent your order; this does not constitute acceptance of the contract by nacani, but is for your information only.
2.3 The contract is only concluded by an explicit order confirmation by e-mail from nacani or by dispatch of the ordered goods.
3 Delivery, availability of goods, right of withdrawal
3.1 The delivery period begins as soon as full payment of the purchase price has been received. Your order will be prepared for dispatch and sent to you within two to three working days after receipt of the purchase price.
3.2 After your order has been shipped, you will receive an e-mail with a tracking number that you can use to track your order online.
3.3 If an ordered product is not available, nacani may refuse your purchase offer. In this case, nacani will inform you immediately and refund any payment already made without delay.
4 Prices, shipping costs, customs duties
4.1 The final prices stated in the webshop include the statutory value added tax. The prices quoted for deliveries to EU countries include the VAT applicable in Germany.
Prices for deliveries to countries in the European Union (“EU”) are quoted in euros (EUR). Any refunds will also be made on the basis of the original payment made by you without taking into account changing exchange rates.
4.2 The purchase price is due immediately upon conclusion of the contract.
4.3 Delivery costs
Germany
Standard (3-5 working days): 4.60 Euro, from 100 Euro order value the order is free of delivery costs.
Austria
Standard (3-5 working days): 10.70 euros, from 200 euros order value the order is free of delivery costs.
EU countries
Standard (3-5 working days): 11.45 – 14.50 euros, varies depending on the country. Orders over 200 euros are free of charge.

4.4 When shipping to non-EU countries, your order may incur additional taxes and costs (e.g. customs duties), which cannot be paid by us or invoiced by us, but must be paid by you directly to the relevant customs or tax authorities. Please contact these authorities for details.
5 Payment, retention of title, insurance
5.1 We only accept the payment methods that are displayed when you place your order: Credit card payments with VISA and MASTERCARD, payment by PAYPAL and SOFORTÜBERWEISUNG, direct bank transfer or SEPA direct debit.
When paying by SOFORT bank transfer, payment is processed by SOFORT GmbH, Fußbergstraße 1, 82131 Gauting, Germany.
If you pay by credit card or another payment method where your account is not held in the currency specified at the time of purchase, your account will be debited on the basis of the exchange rate applicable at the time the transaction is settled by your card provider or payment service provider and determined by them.
Your PayPal payment will be processed by PayPal (Europe) S.à r.l. et Cie, S.C.A., 22-24 Boulevard Royal, L-2449 Luxembourg. The respective terms and conditions of the contractual partners apply. If you pay with PayPal, you will be redirected to the PayPal page at checkout, where you can log in and complete the payment process. As soon as payment has been made, you will be redirected back to nacani.
All transactions on this website are processed via STRIPE. This is a secure online payment portal where your payment details are encrypted in a secure host environment.
nacani GmbH also offers you the option of saving your credit card details so that you can shop with us more quickly and easily. Your credit card number is not displayed in full – only the last four digits are visible. This allows you to quickly and easily identify which of your credit cards you are using. You can delete your credit card details at any time by deactivating the “Save my payment methods” function on the payment page.
Please note that you will need to re-enter your credit card details if you wish to change your existing addresses or add new ones. This is to protect your personal data from third parties.
5.2 The delivered goods remain the property of nacani until full payment has been made
5.3 During transportation, your order is insured by nacani until the time of delivery. Upon delivery and signature, the liability for the purchased items is transferred to you. If you are not the recipient (e.g. in the case of a gift), you accept the fulfillment of the contract by nacani and the transfer of liability to the recipient.
6 Statutory right of withdrawal / returns
6.1 Consumers have a statutory right of withdrawal when concluding a distance selling transaction, about which nacan informs in accordance with the statutory model below.

You have the right to withdraw from this contract within fourteen days without giving any reason.
The revocation period is fourteen days from the day on which you or a third party named by you, who is not the carrier, have taken possession of the goods. If you have ordered several goods as part of a single order and these goods are delivered separately, the withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, have taken possession of the last goods.
To exercise the right of withdrawal, you must inform us (nacani) of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post or e-mail).
To comply with the withdrawal period, it is sufficient that you send the notification of the exercise of the right of withdrawal before the expiry of the withdrawal period.
Exclusion of the right of withdrawal
Packages that have already been opened cannot be returned unless there is a clear product defect.
Consequences of withdrawal
If you withdraw from this contract, all payments that nacani has received from you, including the delivery costs (with the exception of any costs resulting from the fact that you have chosen a different type of delivery than the cheapest standard delivery offered), will be refunded to you immediately and at the latest within fifteen days from the day on which we receive the revoked goods. This refund will be made using the same means of payment that you used for the original transaction, unless expressly agreed otherwise; under no circumstances will you be charged any fees for this refund. Repayment may be withheld until nacani has received the goods back or until you have provided proof that you have returned the goods, whichever is the earliest.
You must return or hand over the goods immediately and in any case within fourteen days at the latest from the day on which you inform nacani of the revocation of this contract. The deadline is met if you send the goods before the period of fourteen days has expired.
You bear the direct costs of returning the goods. The return must be insured and trackable when sent back to nacani. You are only responsible for any loss in value of the goods if this loss results from handling beyond what is necessary to inspect the condition, properties, and functionality of the goods.

Please return only items that are new and unopened. The goods must be returned complete, meaning in the original sales packaging along with any instructions, intact seals, or other components. Returns that do not meet these conditions will not be accepted and will be sent back to you.
7. Legal Warranty
8. Liability for Damages
8.1 nacani is liable for damages in accordance with statutory provisions unless otherwise specified below.
8.2 For breaches of duty—regardless of the legal basis—nacani is responsible for intent and gross negligence within the framework of fault-based liability. Subject to a milder liability standard under statutory provisions (e.g., for diligence in one’s own affairs), nacani is liable for simple negligence only in the following cases:
- For damages resulting from injury to life, body, or health.
- For damages resulting from the significant violation of an essential contractual obligation (an obligation whose fulfillment is essential for the proper execution of the contract and on which the contracting party regularly relies and is entitled to rely); in this case, liability is limited to compensation for foreseeable, typically occurring damages.
These liability limitations also apply to third parties and in cases of breaches of duty by persons for whom nacani is legally responsible.
8.3 The content displayed on the website serves solely for neutral information and general education and is not intended for the diagnosis of diseases. It in no way replaces professional advice from a veterinarian and must not be used as a basis for self-diagnosis or for initiating, modifying, or discontinuing treatment of serious illnesses.
For serious health conditions, pregnancy, or lactation, we recommend consulting a veterinarian before administering any products.
Neither nacani nor its authors assume liability for inconveniences or damages resulting from the use of the information or products presented. The hemp-based products offered are classified as supplementary animal feed and are in no way a substitute for prescribed medication. The texts make no claim to completeness, nor can the accuracy, currency, or balance of the provided information be guaranteed.
9. Consumer Dispute Resolution
The EU Commission has established an online platform for dispute resolution. This platform serves as a contact point for the out-of-court settlement of disputes related to contractual obligations arising from online purchase agreements. However, we are neither obligated nor willing to participate in a dispute resolution procedure before a consumer arbitration board.

11.1 The order and the conclusion of the contract are in German.

12. Final Provisions
12.1 These general terms and conditions and the contractual relationship with you are governed by German law, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
12.2 When the customer places an order through our webshop, only the German version of these terms and conditions applies.
12.3 Should any provision of these general terms and conditions be invalid, the rest of the contract remains valid. The invalid provision will be replaced by the relevant legal regulations.
